Terms & Conditions

The following Terms and Conditions apply to all bookings at Diwali Baug. We kindly ask that you take a moment to read them prior to making a Booking .The Guests and his/her/their companions will have to strictly adhere to the following Terms & Conditions of Diwalibai Jethabhai Khushal Sanitorium Trust ( the Trust).

TARIFF

The Tariff is for the room only and is including the government taxes applicable. Meals and other services are available at extra cost. To know the room tariffs please contact the Manager.

SETTLEMENT OF BILLS

Bills for room stay have to be settled in advance by cash or demand draft in favour of Diwalibai Jethabhai Khushal Sanitorium Trust or deposited into the bank account of the Trust. For transfer of funds to the bank account of the Trust kindly contact the manager. Payment for meals and other services to be settled in cash only. We do not accept payment by cheques or by credit/debit cards.

LIEN

In the case of default in payment of dues by a guest , the Trust shall have a lien on the guests luggage and belongings, and be entitled to detain the same and to sell and auction such property at any time without reference to the guest. The net sale proceeds will be appropriated towards the amount due by the guest without prejudice to the Trust’s right to adopt such further recovery proceeding as may be required.

CHECK IN

Check In Time 12 noon. You will be required to fill in a Reservation Form and provide Identification details for all persons occupying the room except children. You will have to pay in advance the full room rent along with Security Deposit of Rs 1000/- (Rupees One thousand only) which will be refunded to you on your handling back the premises in good condition. On completing the necessary formalities the Manager / Employee of Diwali baug will permit you to use the room. Maximum 4 persons will be allowed in Deluxe & Executive rooms and 6 persons will be allowed in suite. Infants/Children sharing the cot with the parents under 6 years will be allowed to stay free of charge. Any extra person or children above 6 years will be charged extra .For any reason whatsoever the room allotted to the guest is not available, than the guest will accept any other room given to him by our manager without any complaints. Kindly check that all the appliances, furniture, fittings etc. in the room are in order /working condition. If not then immediately report the same to the Manger. If you fail to inform the manager about damaged appliances/fittings and/or furniture then you will be liable to pay for the damaged appliances/fittings and/or furniture.

CHECK OUT

Check out time is 10 am. Please inform the manager if you wish to retain the room beyond check out time. Extention will be given depending on the availability. If room is available then normal tariff will be charged. On failure of guest to vacate the room on expiry or period beyond the check out time , the Trust shall have a right to remove the guest and his/her belongings from the room occupied by the guest and also charge room charges for the next day.

If the guest does not vacate the room even after persuasion by the Trust and/or its employees then guests deposit will be forfeited and guest will be liable to pay double the daily charges which they have paid, as compensation to the Trust. Over and above this compensation guest will be require to pay all the expenses incurred by the Trust to forcible take possession of the room from him.

EXTENTION OF STAY

If for any reason you want to extend your stay then you will have to request the Manager to extend your stay and fill in another Reservation Form . If any rooms are available then you will be asked to pay additional room rent in advance and your stay will be extended.

CANCELLATION OF ROOM BOOKING/ NO SHOW

  • (a) If you vacate the room before expiry date as per your Reservation Form no refund for the unused days will be given.
  • (b) On the day of your booking If you fail to occupy the room by 6 pm in the evening without informing the Manager, then your room booking will stand cancelled automatically and your room shall be allotted to another guest and you will not be eligible for any refund.
  • (c) If for any reason the guest cancels his booking 72 hours prior to his reservation date then 50% of the room rates shall be deducted and the balance 50% of room charges shall be refunded. He will get the refund by an “Account payee” cheque on the client claiming in writing the balance moneys. If the guest cancels his reservation within 72 hours of his reservation then 100 percent of room rates will be deducted.If the guest does not show up on the date of his reservation then 100% of room rate shall be deducted as cancellation charges.

CUT IN ELECTRICITY/WATER

If for any reason there is a cut in Electricity/water supply and the Trust is not able to supply any of it, the guest will not demand any refund nor will he hold the Trust responsible for it and ask for any damages.

RESTRICTIONS

  • (a) Non- Vegetarian food, liquor are strictly forbidden in our premises. Bringing goods and/or storing of raw or exposed cinema films or prohibited goods and/or goods of objectionable nature are strictly prohibited. Gambling, contraband, prostitution, weapons, explosives, flammable objects, poisons, drugs, animals , pungent food and any other illegal activity is also strictly forbidden. Anyone found to be indulging in any of these activities will be asked to vacate the premises forthwith without any refund.
  • (b) Smoking will not be permitted in dining room and other common spaces of the trust premises. Smoking in rooms and/or galleries/terraces will be permitted /allowed with the permission of the manager.
  • (c) The guest or their companions will not be allowed to bring any pets /birds and /or animals together with them to stay at Diwalibaug.
  • (d) Persons with any kind of contagious diseases and / or mental illness is found to using our premises, then the guest will be asked to vacate the premises forthwith without any refund and more over he will be liable for damages caused to other guests in Diwalibaug.
  • (e) Guests picking flowers or breaking fruits or damaging trees on the premises will be fined and liable for any damage caused by them .
  • (f) No hawkers and / or door-to-door salesman will be allowed in the premises
  • (g) You are not allowed to use the Trust Employees for your personal work
  • (h) Any guest misbehaving with our staff or other guests or causing nuisance or disturbing the peace of other guests will be asked to vacate the premises forthwith without any refunds. All guests to ensure that there is no noise pollution in any form and you do not disturb your neighbours.
  • (i) You will not be allowed to take out/shift the appliances /fittings and furniture . In case you want to do so you need to take the permission of our manager.
  • (j) The guest will look after the trust premises. He will not write on the walls, stick paper on the walls or put nails on any walls. He will not damage any part of the Trust premises.
  • (k) Drying of clothes should be done only in the place allotted in your bath room and not in any other premises of the trust.
  • (l) Spitting/disposing garbage to be strictly done in garbage bins.

INSPECTION OF ROOMS

Trustees and Employees of the Trust have a right to visit the rooms any time and / or ask information about guests and the guests shall co operate with the Trust and /or its employees and will not take any objection for the same.

GUEST BELONGINGS

It is the responsibility of the guests to look after their/his/her belongings, valuable articles, jewelry, money, etc. The Guests are requested to lock the doors of their rooms and cupboards . The Trust and/or its employees will not in any way be responsible for any loss/or damage to the Guests belongings or any other property from the room or any part of Diwalibaug for any cause whatsoever including theft and pilferage and the Guest shall be solely responsible for their things, belongings, jewelry money and will not blame the Trust or its employee’s for the same.

BREAKAGE

In case of any damage to the room or loss of equipment or item, guest will be liable to pay the damages at current prices to the Trust/ Manager/ Employee. If everything is in good condition then guest will be refunded his/her/their deposit. Parents of Infants are requested to bring their your own plastic and / or rubber sheet so that Infants/ children do not wet / spoil beds. The Trust shall charge parents for spoiling beds/bedsheets at current prices.

DAMAGE TO PROPERTY

The Guest shall be responsible for any loss or damage to the Diwalibaug property caused by themselves , their guests or any person for whom they are responsible.

POWERS OF TRUSTEES

  • If the guest breaks any terms and conditions of the Trust he/she/they will be expelled from Trust premises forthwith without any compensation and his/her/their deposit will be forfeited. Moreover he/she/they will not be allowed in the Trust Premises in the future and he will also be liable for legal proceeding against them by the Trust.
  • the Trustees have the right to change, add and / or amend the terms and conditions as per their requirement. The reservation form does not create any tenancy rights and / or give any rights to the guests and his/her/their companions to stay in the room as tenants. The property belongs to the Trust and the guest and his/her/their companions
  • If for any reason whatsoever the Trust feels the guest is unsuitable to stay at Diwalibaug then the Trust can ask him to vacate the premises immediately and he will be refunded the balance amount.
  • To give the allocation of rooms is the prerogative of the Trust, and its Trustees. The Trust is not bound to give any explanation to anybody regarding the same.

PARKING RULES

Only authorized vehicles are permitted to park inside Diwalibaug. On payment of extra charges the Trust will allow you to park your vehicle in its compound subject to availability of space in the compound. The Trust and/or its employees shall not be responsible for any damage/loss of vehicles/loss of goods from the vehicle. Driver will be given sleeping facility and food at extra charges.

COMPLAINTS

All complaints will have to be made in writing in the complaint register maintained with the Manager.

FORCE MAJEURE

The Trust accepts no liability and will not pay any compensation where the performance of its obligations is prevented or affected directly or indirectly by or as a result of force majeure or any circumstances beyond its reasonable control including, but not limited to, flood, earthquake, extreme adverse weather conditions, natural disasters, other acts of God, acts of terrorism, fire or failure of electric power, gas, water, or other utility service, plant machinery, computers, vehicles or any collapse of building structures.

GOVERNING LAW & JURISDICTION

The Contract and any non-contractual obligations arising in connection with it are governed by the Laws in India.
The Courts in Mumbai shall have exclusive jurisdiction to determine any dispute arising in connection with the Contract, including disputes relating to any non-contractual obligations.
