The following Terms and Conditions apply to all bookings at Diwali Baug. We kindly ask that you take a moment to read them prior to making a Booking .The Guests and his/her/their companions will have to strictly adhere to the following Terms & Conditions of Diwalibai Jethabhai Khushal Sanitorium Trust ( the Trust).
The Tariff is for the room only and is including the government taxes applicable. Meals and other services are available at extra cost. To know the room tariffs please contact the Manager.
Bills for room stay have to be settled in advance by cash or demand draft in favour of Diwalibai Jethabhai Khushal Sanitorium Trust or deposited into the bank account of the Trust. For transfer of funds to the bank account of the Trust kindly contact the manager. Payment for meals and other services to be settled in cash only. We do not accept payment by cheques or by credit/debit cards.
In the case of default in payment of dues by a guest , the Trust shall have a lien on the guests luggage and belongings, and be entitled to detain the same and to sell and auction such property at any time without reference to the guest. The net sale proceeds will be appropriated towards the amount due by the guest without prejudice to the Trust’s right to adopt such further recovery proceeding as may be required.
Check In Time 12 noon. You will be required to fill in a Reservation Form and provide Identification details for all persons occupying the room except children. You will have to pay in advance the full room rent along with Security Deposit of Rs 1000/- (Rupees One thousand only) which will be refunded to you on your handling back the premises in good condition. On completing the necessary formalities the Manager / Employee of Diwali baug will permit you to use the room. Maximum 4 persons will be allowed in Deluxe & Executive rooms and 6 persons will be allowed in suite. Infants/Children sharing the cot with the parents under 6 years will be allowed to stay free of charge. Any extra person or children above 6 years will be charged extra .For any reason whatsoever the room allotted to the guest is not available, than the guest will accept any other room given to him by our manager without any complaints. Kindly check that all the appliances, furniture, fittings etc. in the room are in order /working condition. If not then immediately report the same to the Manger. If you fail to inform the manager about damaged appliances/fittings and/or furniture then you will be liable to pay for the damaged appliances/fittings and/or furniture.
Check out time is 10 am. Please inform the manager if you wish to retain the room beyond check out time. Extention will be given depending on the availability. If room is available then normal tariff will be charged. On failure of guest to vacate the room on expiry or period beyond the check out time , the Trust shall have a right to remove the guest and his/her belongings from the room occupied by the guest and also charge room charges for the next day.
If the guest does not vacate the room even after persuasion by the Trust and/or its employees then guests deposit will be forfeited and guest will be liable to pay double the daily charges which they have paid, as compensation to the Trust. Over and above this compensation guest will be require to pay all the expenses incurred by the Trust to forcible take possession of the room from him.
If for any reason you want to extend your stay then you will have to request the Manager to extend your stay and fill in another Reservation Form . If any rooms are available then you will be asked to pay additional room rent in advance and your stay will be extended.
If for any reason there is a cut in Electricity/water supply and the Trust is not able to supply any of it, the guest will not demand any refund nor will he hold the Trust responsible for it and ask for any damages.
Trustees and Employees of the Trust have a right to visit the rooms any time and / or ask information about guests and the guests shall co operate with the Trust and /or its employees and will not take any objection for the same.
It is the responsibility of the guests to look after their/his/her belongings, valuable articles, jewelry, money, etc. The Guests are requested to lock the doors of their rooms and cupboards . The Trust and/or its employees will not in any way be responsible for any loss/or damage to the Guests belongings or any other property from the room or any part of Diwalibaug for any cause whatsoever including theft and pilferage and the Guest shall be solely responsible for their things, belongings, jewelry money and will not blame the Trust or its employee’s for the same.
In case of any damage to the room or loss of equipment or item, guest will be liable to pay the damages at current prices to the Trust/ Manager/ Employee. If everything is in good condition then guest will be refunded his/her/their deposit. Parents of Infants are requested to bring their your own plastic and / or rubber sheet so that Infants/ children do not wet / spoil beds. The Trust shall charge parents for spoiling beds/bedsheets at current prices.
The Guest shall be responsible for any loss or damage to the Diwalibaug property caused by themselves , their guests or any person for whom they are responsible.
Only authorized vehicles are permitted to park inside Diwalibaug. On payment of extra charges the Trust will allow you to park your vehicle in its compound subject to availability of space in the compound. The Trust and/or its employees shall not be responsible for any damage/loss of vehicles/loss of goods from the vehicle. Driver will be given sleeping facility and food at extra charges.
All complaints will have to be made in writing in the complaint register maintained with the Manager.
The Trust accepts no liability and will not pay any compensation where the performance of its obligations is prevented or affected directly or indirectly by or as a result of force majeure or any circumstances beyond its reasonable control including, but not limited to, flood, earthquake, extreme adverse weather conditions, natural disasters, other acts of God, acts of terrorism, fire or failure of electric power, gas, water, or other utility service, plant machinery, computers, vehicles or any collapse of building structures.
While all reasonable efforts have been taken to ensure the accuracy of information on the Websites, the Trust does not accept responsibility for errors or omissions and reserve the right to amend, cancel or vary any of the arrangements featured on the Websites without notice. Please note that in certain circumstances, generic photographic images have been used to represent the general style of a particular product. The content of the Websites is the copyright of the Trust, and may not be copied, reproduced, published, distributed or amended for any other purpose without our prior written consent. Trade marks used on the Websites are the property of the respective owners. Hyperlinks to third party websites are provided for your convenience. We cannot accept responsibility for the content or use of third party sites.
The Contract and any non-contractual obligations arising in connection with it are governed by the Laws in India.
The Courts in Mumbai shall have exclusive jurisdiction to determine any dispute arising in connection with the Contract, including disputes relating to any non-contractual obligations.
